Introduction

Welcome to the Digicel Call International Privacy Notice.

At Digicel, we respect your privacy, and we are committed to protecting your personal data and earning your trust. We have prepared this Privacy Notice to give you clarity and transparency on the ways in which we may use your personal data. We take reasonable steps to ensure that your data is safe and secure, including putting in place technical safeguards, organisational measures, policies, and procedures to comply with applicable laws and regulations.

This Privacy Notice is supplemental to the Digicel Call International Terms and Conditions. Terms capitalised in this document shall have the same meanings ascribed in the Terms and Conditions, unless otherwise specified.

1. Data Controller

Digicel Caribbean Limited is the Data Controller (referred to as “Digicel”, "we", "us" or "our" in this privacy notice) of data collected solely through the provision and use of the Digicel Call International Application and Services. Digicel is a company registered under the laws of Barbados with registered office at One Welches, Welches, Barbados. We are a subsidiary of the Digicel Group of Companies.

We have a Group Privacy Team responsible for handling all enquiries in relation to the privacy practices of Digicel Call International. If you have any questions about this privacy notice, including any requests to exercise your legal rights, you may contact our Privacy Team using the details set out at Item 13 below.

Depending on the market or territory within which you reside, you may also have the right to make a complaint to your regulator of privacy rights or data protection issues. However, we would appreciate the chance to deal with your concerns before you approach your regulator, so please contact us first.

2. Scope of This Notice

Purpose of this Privacy Notice
This Privacy Notice aims to give you information on how Digicel collects and processes your personal data through your use or interaction with our Digicel Call International Android and iOS applications, available only through Google Play and App Store, respectively (collectively referred hereinafter as “Application”). This includes any data you may provide through the Application when you register, utilise the Services (i.e., telephony, in-app messaging, mobile top-up transactions), are referred by a customer, take part in a promotion or competition, or get in contact with us.

If you wish to make a referral as a customer, we advise that you ensure this Privacy Notice is read, together with the Terms and Conditions, by the Referral, to ensure you have their consent for the collection and processing of their personal data before submitting their details. Further, you understand that Digicel will refer to certain aspects of your personal data provided to us to inform the Referral of how their personal data was obtained.

Our goal is for you to understand i) how we look after your personal data, and ii) your privacy rights and how the law protects you.

Different products and services collect different kinds of data. It is important that you read this Privacy Notice together with any other privacy, customer, or regulatory notices we may provide for specific products and services, and on specific occasions when we are collecting or processing personal data about you, so that you are fully aware of how and why we are using your data. This privacy notice supplements other notices published by the Digicel Group of Companies and is not intended to override them.

Personal Data of Minors

Our Application is not intended for minors. Nonetheless, we do not knowingly collect data from or about individuals under the legal minimum age without the permission of their parent or guardian. When we do collect that data, we might do it inadvertently, like if they attempt to sign up for our Application. We might also collect it automatically if, through your permission or supervision, your child uses the Application or the Services offered. If you believe your child may have provided us with personal information without proper consent, you can contact us and request that we delete the information.

Third-party links

Our Application may include links to third-party applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party applications and are not responsible for their privacy statements. Where necessary, we will provide a notice and link to the third party’s notice. When you leave our Application, we encourage you to read the privacy notice of every other application and website you visit.

In-App Messaging

The Digicel Call International in-app messaging feature requires access to your device’s contacts to determine if existing phone numbers are Digicel Call International customers by looking them up in our database. We do not share or sell your contact phone numbers and only use the phone numbers for in-app messaging purposes. Contact phone numbers are only looked up and stored in our database after sending an in-app message to that phone number. Contact phone numbers and your messages are encrypted during transit and at rest. You can delete the contact phone number and message from our database by pressing on the message and selecting the ‘Delete’ option.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

7. International Transfers

We share your personal data within entities throughout the Digicel Group of Companies.

Whenever we transfer your personal data out of the country of origin, however, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

• We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data.
• Where we use certain service providers, we may use specific contracts that ensure an adequate level of protection through the use of technical and organizational measures.

Please contact us if you want further information on the specific mechanism used by us when transferring your personal data internationally.

8. Data Security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

Please be aware that although we endeavour to provide reasonable security for the information we process and maintain, no security system can prevent all potential security breaches. In any event, we will notify you and any applicable regulator of a breach where we are legally required to do so.

9. Account Deletion & Data Retention

How Long Will You Use My Personal Data For?

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

Where you have decided to withdraw the consent you have given, we will delete your personal data unless we are required to keep it for the reasons explained herein. We may need to keep a piece of your contact information e.g., e-mail address, in our records, so we know that you have withdrawn your consent and therefore ensure we honour your choice.

Details of retention periods for different aspects of your personal data are available in our retention schedule which you can request from us by contacting us at privacy@digicelgroup.com.

10. Your Legal Rights

In some countries and under certain circumstances, you have rights in relation to your personal data. You may have the right to:

Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.

Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios:

• If you want us to establish the data's accuracy.
• Where our use of the data is unlawful but you do not want us to erase it.
• Where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims. In order to exercise any such legal claim, we may require a court or administrative order, subpoena or other such legal or regulatory proclamation.
• You have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain services to you. We will advise you if this is the case at the time you withdraw your consent.

If you wish to enquire about or exercise any of the rights set out above, visit our Privacy & Trust Centre or contact the Privacy Team at privacy@digicelgroup.com.

What we may need from you

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Time limit to respond

We try to respond to all legitimate requests within sixty (60) days. Occasionally it could take us longer than sixty (60) days if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
